1. Introduction

Effective date: 5 January 2026

These Terms & Conditions (“Terms”) govern your use of oxygen-at.com (the “Website”), purchases made through the Website, participation as a marketplace seller (“Vendor”), and participation in any Oxygen-AT affiliate programme (“Affiliate Programme”). By using the Website, placing an order, registering a Vendor account, or joining the Affiliate Programme, you agree to these Terms, our Privacy Policy, and any other policies referenced (including our Returns Policy, Shipping Policy, Cookie Policy, and any programme-specific rules).

Throughout these Terms, “”Oxygen Adventure Training ,“Oxygen-AT”, “we”, “us”, “our” refers to the sole trader operating this Website (David Lamb, United Kingdom). “You” refers to any user of the Website (including Customers, Vendors, and Affiliates).

Nothing in these Terms affects your statutory rights as a consumer.

We are not VAT-registered at this time (if this changes, we will update our details).

3. Definitions

  • Customer: a person purchasing goods via the Website.
  • Vendor / Seller: a third-party business or individual approved to sell products through our marketplace tools.
  • Marketplace: the parts of the Website where Vendors list and sell products to Customers.
  • Product: any item offered for sale on the Website, whether sold by Oxygen-AT or a Vendor.
  • Affiliate: a person or business approved to promote Oxygen-AT via tracked links/codes.
  • Affiliate Link / Code: a unique tracking link or discount/attribution code assigned to an Affiliate.

4. Use of Our Website

  • Eligibility: You must be at least 18 years old (or the legal age of capacity in your country) to place an order or participate as a Vendor/Affiliate.
  • Accounts: If you create an account, you are responsible for safeguarding your login credentials and ensuring your account details are accurate. Notify us immediately of any unauthorised use.
  • Website content: Unless stated otherwise, Website content (text, images, logos, product copy) is owned by or licensed to Oxygen-AT and is for personal, non-commercial use. You may share product links, but you may not reproduce Website content for commercial purposes without permission.
  • Prohibited use: You must not misuse the Website (including hacking, introducing malware, fraud, unlawful activity, or disrupting the Website). We may suspend or terminate access where necessary.

5. Marketplace and Multi-Vendor Terms

5.1 Marketplace model (who you are buying from)

Some products on the Website are sold directly by Oxygen-AT. Other products are sold by independent Vendors using our marketplace. The product page and/or checkout will indicate the seller of record.

  • If the product is sold by Oxygen-AT, your contract is with Oxygen-AT.
  • If the product is sold by a Vendor, your contract is with the Vendor, and Oxygen-AT acts as the marketplace operator (and may provide payment processing and customer support tooling).

5.2 What Oxygen-AT is (and is not) responsible for

We operate the Website and provide marketplace functionality. Vendors are responsible for:

  • the accuracy of their listings
  • ensuring their products are lawful and compliant
  • fulfilling orders
  • handling product-specific issues (defects, recalls, safety notices)
  • meeting consumer-law obligations applicable to them

Where we collect payment on behalf of a Vendor, we may assist with refund processing and communications; however, the Vendor remains responsible for performance of the sale contract.

5.3 Customer service and disputes for Marketplace orders

If you have a problem with a Marketplace order, you should:

  1. contact us via support@oxygen-at.com (we’ll route it to the Vendor if needed)
  2. follow our Returns Policy and Shipping Policy processes

We may share necessary order details with the Vendor to resolve your issue (see Privacy section).

5.4 Vendor eligibility, standards and enforcement

Vendors must:

  • provide accurate business/contact information and keep it updated
  • list products honestly (pricing, delivery times, specifications)
  • comply with applicable laws (including product safety and consumer protection)
  • fulfil orders within stated timeframes
  • handle returns/refunds in line with applicable law and the marketplace policies
  • not list prohibited or unsafe items

We may suspend, restrict, or remove Vendor listings/accounts (without liability) if we suspect policy breaches, fraud, unsafe products, or legal non-compliance.

5.5 Vendor content and intellectual property

Vendors retain ownership of their own trademarks and original content they upload. By uploading content (images, product text, branding), Vendors grant Oxygen-AT a licence to display, distribute, and promote that content on the Website and in marketing for the purpose of operating the marketplace.

6. Product Information

We aim to describe products as accurately as possible. However:

  • images may vary slightly due to lighting or screen settings
  • specifications may be updated by a manufacturer/supplier
  • minor variations do not automatically mean an item is “not as described”

If you believe an item is significantly not as described, you may be entitled to a remedy under your statutory rights and our Returns Policy.

  • Availability: Stock can change quickly (especially for Vendor or third-party supplied items). If an item becomes unavailable, we will notify you and offer alternatives or a refund.
  • Pricing & errors: Prices are shown in GBP (£) unless stated otherwise. We may correct obvious errors. If an item was mispriced, we will contact you and you can reconfirm at the correct price or cancel for a refund.

7. How to Order

  • Placing an order: Adding items to your basket and submitting checkout is an offer to buy.
  • Order confirmation: The confirmation email acknowledges receipt of your order. A binding contract is formed when the item is dispatched and you receive dispatch confirmation (or equivalent confirmation of fulfilment).
  • Refusal/cancellation: We may refuse or cancel orders for reasons such as stock unavailability, suspected fraud, delivery restrictions, or pricing errors. If cancelled, you will not be charged (or you will be refunded promptly).
  • Changes: Contact us immediately if you need to amend an order. After dispatch, changes are usually not possible.

8. Payment Terms

We accept major cards via Stripe, Apple Pay, Google Pay, and PayPal (as available at checkout). Payment is typically taken at order placement (or shortly after).

We do not store full card details; payment is handled by PCI-DSS compliant providers.

If payment is declined or suspected fraudulent, we may cancel the order.

9. Shipping & Delivery

Shipping is governed by our Shipping Policy. Key points:

  • delivery timelines are estimates, not guarantees
  • risk passes to you upon delivery to the provided address
  • customs duties/import taxes may apply for international orders (your responsibility unless stated otherwise)
  • incorrect addresses and unclaimed parcels may cause delays/extra costs

If delivery has not occurred within 30 days (and no longer period was agreed), you may have cancellation rights under applicable consumer law.

10. Cancellation, Returns & Refunds

Our Returns & Refunds Policy forms part of these Terms.

Highlights:

  • UK/EU right to cancel: typically 14 days after delivery for distance sales (with certain exclusions).
  • Faulty/not as described: you may be entitled to repair/replacement/refund under statutory rights.
  • Return condition: take reasonable care of items; deductions may apply for diminished value where permitted.
  • Marketplace orders: returns/refunds may involve the Vendor, but we may facilitate the process.

11. Reviews, Ratings and User Content

You may be able to submit reviews or other content. You agree:

  • your content is truthful and not misleading
  • it is not abusive, unlawful, defamatory, or infringing
  • we may moderate/remove content at our discretion (e.g., spam, harassment, irrelevant content)

12. Affiliate Marketing and Affiliate Programme

12.1 Affiliate links on oxygen-at.com (our disclosures)

We may sometimes publish links that earn us a commission (for example, product/tool recommendations). Where we do, we will label or disclose this appropriately.

12.2 Affiliate Programme (promoting Oxygen-AT)

If you join our Affiliate Programme, you agree to the additional rules below.

12.2.1 Disclosure and advertising compliance

Affiliates must clearly disclose the commercial nature of their content whenever promoting Oxygen-AT using affiliate links/codes (for example “Ad”, “Affiliate link”, “Paid partnership”, or equivalent). Disclosures must be clear and prominent and comply with applicable advertising/consumer protection rules.

12.2.2 Acceptable promotion methods

You may promote Oxygen-AT through your website, blog, email list (opt-in only), and social media, provided you comply with these Terms and applicable laws.

You must not:

  • use spam or unsolicited messages
  • make misleading claims (pricing, availability, health/performance claims, “official” endorsements)
  • impersonate Oxygen-AT or represent yourself as our employee/agent
  • use misleading “voucher” or “discount” claims
  • use cookies/forced clicks or other deceptive tracking methods

12.2.3 Brand, domains and paid ads

Unless we give written permission, you must not:

  • register domains or social handles confusingly similar to Oxygen-AT
  • bid on “Oxygen-AT” (and close variants) as paid search keywords
  • run ads that appear to be official Oxygen-AT ads

12.2.4 Tracking, commissions and changes

Tracking is usually via cookies and/or attribution rules. Commissions (if any) may be changed, paused, or withdrawn at any time. We may void commissions where we reasonably suspect fraud, misuse, self-referrals, cancellations/returns, or policy breaches.

12.2.5 Termination

We may suspend or terminate Affiliate participation immediately if you breach these Terms or applicable laws, or if we suspect fraudulent activity.

13. Liability and Limitations

  • Product misuse: We are not responsible for damage/injury caused by misuse or failure to follow instructions/warnings.
  • Website availability: We do not guarantee uninterrupted access to the Website.
  • External links: We are not responsible for third-party websites or their practices.
  • Force majeure: We are not liable for delays/failures caused by events outside our reasonable control.
  • Limitation of liability: To the fullest extent permitted by law, our total liability for a claim relating to a purchase is limited to the amount paid for the relevant product(s). We do not exclude liability where it cannot be excluded (e.g., death/personal injury due to negligence, fraud).
  • Indemnity: You agree to indemnify Oxygen-AT for losses arising from your breach of these Terms or unlawful use of the Website.

14. Privacy and Data Protection

Your personal data is handled according to our Privacy Policy and Cookie Policy. We may share necessary order details with Vendors for fulfilment, customer service, returns, and legal compliance.

15. Intellectual Property

All Oxygen-AT branding and Website content is protected by intellectual property laws. You may not use our trademarks or content commercially without permission. Vendors retain rights in their own uploaded content, subject to the licence in section 4.5.

16. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales. If you are a consumer residing outside England and Wales, you may also benefit from mandatory consumer protections in your country of residence.

Online Dispute Resolution (EU ODR): The EU ODR platform was discontinued and is closed (as of 20 July 2025).

We encourage you to contact us first to resolve disputes amicably. UK consumers may also have access to Alternative Dispute Resolution options depending on the issue and provider.

17. Changes to These Terms

We may update these Terms at any time by posting a new version on the Website with an updated effective date. Orders remain governed by the Terms in force at the time the order was placed.

18. Miscellaneous

  • Severability: If any provision is unenforceable, the remainder continues in effect.
  • Entire agreement: These Terms and referenced policies form the entire agreement.
  • Transfer: We may transfer rights/obligations if the business is sold/merged; your rights are unaffected.
  • Third-party rights: The Contracts (Rights of Third Parties) Act 1999 does not apply.
  • Waiver: Delays in enforcement do not waive rights.
